Terms of Service

The rules for using Fight Week Picks.

1. These terms

These terms of service form a legally binding agreement between you and Fight Week Picks. They apply whenever you use fightweekpicks.com or hold an account with us.

By creating an account or otherwise using the site, you confirm that you accept these terms. If you do not accept them, please do not use the site.

We recommend you keep a copy. These terms are written in English and all communication between us will be in English.

2. Who we are

Fight Week Picks is operated from the United Kingdom by an individual sole trader. You can reach us at hello@fightweekpicks.com. A postal address is available on request.

References to “we”, “us” and “our” mean Fight Week Picks. References to “you” and “your” mean the person using the site.

3. Who can play

• You must be at least 16 years old to create an account.
• You must be able to enter into a binding agreement, and not be barred from doing so under any applicable law.
• You must not have had a previous account closed by us for breach of these terms.
• You are responsible for making sure that using the site is lawful where you live. If it is not, do not use it.

If we learn that an account belongs to someone under 16, we will close it and delete the associated data.

4. Your account

• You may hold one account only. Additional or duplicate accounts may be closed without notice.
• Give us accurate information when you register, and keep your email address up to date so we can reach you.
• Keep your password confidential. You are responsible for everything done through your account.
• Do not share your account, sell it, or transfer it to anyone else.
• Tell us promptly at hello@fightweekpicks.com if you think someone else has accessed your account.

You can close your account at any time by contacting us. Section 13 explains what happens to your data.

5. How the game works

The full scoring rules are published on our scoring page and form part of these terms.

• Picks lock when the first fight on a card begins. After that, no pick on that card can be added, changed or removed, including for bouts later in the night.
• Lock times are taken from scheduled start times supplied by our data provider. Schedules change. We are not responsible if a card begins earlier than advertised and your picks lock sooner than you expected.
• Cancelled, postponed and rescheduled bouts are voided. Nobody scores on a voided bout and nobody is penalised for having picked it.
• Fighter replacements void the bout, since you picked a contest that is no longer happening.
• Draws and no contests are voided.
• We may correct scores at any time if a result was recorded incorrectly. Leaderboards may change as a result.
• We may change the scoring rules. Where we do, we will publish the change and it will apply from the next card onwards, not retrospectively.

Points, ranks, badges and league positions have no monetary value, cannot be exchanged for anything, and cannot be transferred between accounts.

6. This is not gambling

Nothing on this site is a recommendation, tip or inducement to bet. If you choose to gamble elsewhere, that is entirely your own decision and at your own risk. We accept no responsibility for any loss arising from bets placed with any operator, whether or not influenced by anything you saw here.

7. Fight data and results

Fight cards, fighter names, scheduled times, results, finishing methods and rounds are supplied to us automatically by a third party sports data provider. We do not generate this information ourselves and we cannot guarantee that it is complete, accurate or timely.

• Cards may be listed late, incompletely, or with bouts that are later removed.
• Results may arrive late or, occasionally, be wrong.
• Scheduled times may not match the actual start time of an event.

If you believe a result is wrong, tell us at hello@fightweekpicks.com with the card and the fight, and we will look into it and rescore if needed. Our decision on scoring and voiding is final.

8. Acceptable use

You agree not to:

• Create more than one account, or use another person’s account.
• Use bots, scripts, scrapers or automated means to make picks, harvest data or interact with the site.
• Attempt to manipulate leaderboards, the underdog bonus, or any league standing.
• Attempt to gain unauthorised access to any part of the site, another user’s account, or our servers.
• Probe, scan or test the vulnerability of the site, or breach any security or authentication measure.
• Introduce malware, or do anything that places an unreasonable load on our infrastructure.
• Harass, threaten, abuse, impersonate or defame anyone.
• Use the site to advertise, promote, or send unsolicited messages.
• Use the site for any unlawful purpose, or in breach of any law that applies to you.
• Copy, reproduce, resell or commercially exploit any part of the site without our written permission.

9. Display names and leagues

You choose a display name that is visible to other players. You must not choose a name that:

• Is obscene, hateful, harassing or discriminatory.
• Impersonates another person, a fighter, a promotion, a brand or us.
• Infringes anyone’s trade mark or other rights.
• Advertises anything, or contains a web address.

The same applies to league names. We may change or remove any display name or league name that breaches these rules, without notice.

If you create a league you are responsible for who you share the code with. League owners may delete their league, which removes it for every member. We are not a party to any arrangement between members of a private league.

10. Availability and changes

We provide the site free of charge and on an “as available” basis. We do not guarantee that it will be available at any particular time, or that it will be uninterrupted or error free.

We may suspend, withdraw, restrict or change all or any part of the site, including scoring rules, leagues, leaderboards and features, without notice. We may also stop operating the site altogether. If we plan to close the service permanently, we will give account holders reasonable notice by email where we can.

You are responsible for your own internet access, device and any charges that come with them.

11. Intellectual property

The Fight Week Picks name, logo, site design, text, layout, scoring system and software are owned by us or licensed to us, and are protected by copyright and other rights. You may use the site for your own personal, non-commercial enjoyment. You may not copy, adapt, republish or distribute any part of it without our written permission.

You keep ownership of any content you submit, such as a display name or league name. By submitting it, you grant us a non-exclusive, worldwide, royalty free licence to host, store and display that content for the purpose of operating the site. This licence ends when the content is deleted, except where we need to keep records for legal reasons.

12. Third party names and links

All promotion names, event names, fighter names and associated marks are the property of their respective owners. They are used on this site solely to identify real fixtures and results, which is a descriptive and factual use. Fighter images are supplied by our data provider, who does not claim ownership of them.

The site may contain links to other websites. We do not control them, we do not endorse them, and we are not responsible for their content or their privacy practices.

13. Suspension and closing accounts

We may suspend or close your account, remove content, or restrict your access if:

• You breach these terms, or we reasonably suspect you have.
• We are required to by law, or by a regulator or court.
• Your account has been inactive for a prolonged period.
• We stop operating the site.

Where it is reasonable and lawful to do so, we will tell you why and give you a chance to respond. If you think we have got it wrong, email hello@fightweekpicks.com and we will review it.

You may close your account at any time. When an account is closed we remove your login details and personal data as described in our privacy policy. We may keep historical scores in an anonymised form so that past leaderboards remain accurate.

14. Disclaimers

To the extent permitted by law, the site is provided without warranties of any kind, whether express or implied. In particular we do not warrant that:

• The site will be available, uninterrupted, secure or free of errors.
• Fight cards, times, results or scores will be accurate or complete.
• Any defect will be corrected, or that the site is free of viruses.

Nothing on the site is professional advice of any kind, and nothing on it should be relied on for any purpose beyond playing the game.

15. Our liability to you

Subject to the above, and because the site is provided free of charge:

• We are not liable for any loss of profit, loss of opportunity, loss of data, or any indirect or consequential loss, however it arises.
• We are not liable for any loss arising from inaccurate fight data, an incorrect score, a missed lock deadline, or the site being unavailable.
• We are not liable for any loss arising from gambling, wherever and however it takes place.
• We are not liable for anything caused by an event outside our reasonable control, including failures by our host, our data provider or your internet connection.
• Where liability cannot be excluded, our total liability to you for all claims connected with the site is limited to £100.

We are only responsible for loss that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

If you are using the site in the course of a business, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

16. Privacy

How we handle your personal data is set out in our privacy policy, which forms part of these terms. Please read it.

17. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the game, to our suppliers, or to the law. The date at the top shows when they were last revised.

If we make a material change, we will tell account holders by email or by a prominent notice on the site before it takes effect. Continuing to use the site after a change takes effect means you accept the updated terms. If you do not accept them, close your account.

18. Law and disputes

These terms and any dispute arising out of them are governed by the law of England and Wales.

You and we agree that the courts of England and Wales have jurisdiction. However, if you are a consumer, you may also bring proceedings in the courts of the country where you live, and you have the benefit of any mandatory consumer protection rules of that country. If you live in Scotland or Northern Ireland, you may bring proceedings in your own courts.

Please contact us first at hello@fightweekpicks.com. Most problems are quicker to sort out directly, and we would rather fix something than argue about it.

19. General

• Whole agreement. These terms, the scoring page and the privacy policy are the entire agreement between us about the site.
• Severability. If any part of these terms is found to be unlawful or unenforceable, the rest continues to apply.
• No waiver. If we do not enforce a term straight away, that does not mean we have given up the right to do so later.
• Assignment. You may not transfer your rights under these terms. We may transfer ours if the site changes hands, and will tell you if that happens.
• Third parties. Nobody other than you and us has any right to enforce these terms.
• Survival. Sections 11, 12, 14, 15, 18 and 19 continue to apply after your account is closed.
